On November 13, 2013 Vasil Kisil & Partners and the International Chamber of Commerce (ICC) held the Young Arbitrators Forum (YAF): “Third Parties” in International Arbitration”. This event took place in CITYHOTEL, Kiev on the eve of the Kiev Arbitration Days 2013.
The seminar was an ideal forum for young practitioners to exchange thoughts on international arbitration, and to enrich their network in the region. The ICC YAF in Kiev gathered over 60 international arbitration practitioners from Austria, France, Germany, Poland, Russia, Ukraine, and the United Kingdom.
On behalf of the hosts and the ICC YAF, José Ricardo Feris, ICC International Court of Arbitration (France) and Oleksiy Filatov, Vasil Kisil & Partners (Ukraine), welcomed the Forum participants to discuss the recent trends and changes in the practice of international arbitration and noted great interest raised by the topic of the conference.
The Forum started with the keynote speech “Arbitration Agreement and Third Parties” by the special guest, Dr. Marc Blessing, Bär & Karrer AG (Switzerland), Chartered Arbitrator (CIArb), Honorary President Swiss Arbitration Association, lecturer at Universities of Zürich and St.Gallen, an internationally renowned expert in international arbitration and arbitrator with more than thirty years of experience. In his speech Dr. Marc Blessing touched upon the most controversial and widely discussed issues of extending an arbitration agreement to non-signatories and piercing the corporate veil. Dr. Blessing shared with the Kiev Forum participants his extensive experience in dealing with the above issues from the arbitrator’s perspective.
The panel discussion was moderated by Prof. Dr. Richard Kreindler, Cleary Gottlieb Steen & Hamilton LLP, who was faced with handling many questions from the floor and a very lively debate. The panel members included José Ricardo Feris, ICC International Court of Arbitration, Maria Gritsenko, Skadden, Arps, Slate, Meagher & Flom LLP, Oleksiy Filatov, Vasil Kisil & Partners, and Irina Nazarova, ENGARDE Attorneys at Law.

- Enforcement of Awards against Non Signatories
In particular, the panel members discussed the ICC Arbitration Rules, practice of the ICAC Ukraine and other arbitral institutions as well as recent relevant English cases. The participants actively asked questions to the speakers as well as shared their experience and opinions.
