Vasil Kisil & Partners lawyers organising and conducting a roundtable on regulating franchising in Ukraine

On August 19, 2008, the European Business Association (EBA) conducted a roundtable on legal regulation of franchising in Ukraine initiated by EBA franchising working group members: a senior associate with Vasil Kisil & Partners - Nataliya Mykolska, acting as a moderator and a main speaker, and an associate with Vasil Kisil & Partners - Angela Makhinova, commenting some problematic issues.

During the roundtable a lot of hot issues related to franchising development in Ukraine were discussed, including: a draft law “On Amending the Civil Code of Ukraine and the Commercial Code of Ukraine as to State Registration of Commercial Concession Agreements” registered at Verhovna Rada of Ukraine; procedure of state registration of commercial concession (franchising) agreements; specifics of state registration of sub-concession agreements; information to be submitted for the purposes of state registration of commercial concession (franchising) agreements and to be released, and so forth.

Aside from EBA franchising working group members, the roundtable was attended by representatives of numerous law and consulting firms, franchising business in Ukraine as well as State Department on Intellectual Property representatives. 
 
Throughout the discussion, roundtable participants produced and negotiated a unified position on all problematic issues. They also reached an agreement on the fact that EBA franchising workgroup in close collaboration with state IP department representatives should work out a draft law “On state registration of commercial concession and/or sub-concession agreements” taking in consideration the unified position on the issue established during the event. The final version of this draft law is to be discussed during another roundtable in September of 2008.
 
Based on roundtable results there was a press conference organised for leading business mass-media representatives, including TV channels. Aside from state registration of commercial concession (franchising) agreements, a lot of other issues relevant to the overall development of franchising in Ukraine were raised during the press conference.
