Vasil Kisil & Partners Successfully Represents Real Estate Company in Tax Dispute before Superior Administrative Court of Ukraine

The attorneys of Vasil Kisil & Partners have successfully represented a Ukrainian real estate company in a VAT refund dispute before the Superior Administrative Court of Ukraine. The cassation court has upheld the decisions of the first and appellate instance courts and decided that the company is entitled to the VAT refund of over UAH 12 million, which was denied by tax authorities. 

The company was represented in the tax dispute by managing partner Andriy Stelmashchuk and associate Tetyana Berezhna. Tetyana Berezhna believes that the failure of the company’s counterparties to comply with the tax legislation, even if this had been the case, may not result in the company being deprived of its entitlement to the VAT refund, as the company has acted in good faith and performed its obligations before the State budget.
