Litigation practice in Disputes over Security for Obligations

The Second Annual Forum of Legal Advisers organized by Yuridicheskaya Practika in Kyiv has once again brought together the most prominent litigation practitioners. Heads of legal departments of major companies discussed the mechanisms of ensuring the legal security of businesses in the current political and economic environment. Their professional external legal counsels generously shared their recipes for efficient interaction with tax authorities, successful international trade, and intellectual property protection.
Litigation craftsmanship panel became one of the most interesting and relevant sections of this Forum. This panel was complemented by the speech of Alexei Sluch, Counsellor with Vasil Kisil & Partners, who focused on: “Litigation practice in Disputes over Security for Obligations”.
In his speech Alexei Sluch updated the attendees on the present-day litigation over the application of the provisions on securing obligations, gave an insight into such litigation peculiarities, and highlighted both the variety of legal positions and opinions on some matters and the stability of litigation on other issues.
He particularly emphasized the established legal positions regarding some types of security for obligations (default interest, some issues pertaining to the provision of surety and security deposits), while simultaneously pointing out that opinions are divided on other issues (release of surety, mortgage issues).
