Vasil Kisil & Partners Successfully Represented Maksym Nefyodov in a Dispute with NACP

Vasil Kisil & Partners has represented successfully Maksym Nefyodov, Head of the State Customs Service of Ukraine, in a legal action brought based on a report of the National Agency on Corruption Prevention (NACP), which case was heard in Pecherskyi District Court of Kyiv. NACP issued the report on a corruption-related administrative offense allegedly committed by Maksym Nefyodov while he held the position of First Deputy Minister of Economic Development and Trade of Ukraine. Attorneys of Vasil Kisil & Partners successfully proved in court that Mr Nefyodov's actions had never constituted any fact or component elements of a corruption-related offense. Consequently, the court dismissed the case.
The project team comprised of Managing Partner Andriy Stelmashchuk, Counsel Tetyana Berezhna, and associates Anatoliy Pashynskyi, Viktor Hrabovskyi and Anna Yatsyshyn.
"Now NACP often operates inefficiently as it refers to court reports that are groundless and unreasonable. Such cases put pressure on good-faith public officers and their lengthy trials overload the judiciary system," commented Tetyana Berezhna, who acted for Maksym Nefyodov in court.
In return, Maksym Nefyodov noted that NACP must change its formalist approach to the evaluation of declaration subjects' actions and to its reporting.
