On 24 March 2009 the Delo press center held another round table discussion arranged by editorial office of The Yuridicheskaya Gazeta. This time the event was attended by legal firms' representatives, renowned politicians and journalists from specialized medias. The discussion canvassed the issue of corporate taxation in crisis and was dedicated to analysis of new trends and approaches in dealing with tax offices.

The focus was on tax planning issues, certain options for delivering brand-new services and novel principles of relations with authorities of State Tax Administration of Ukraine and other related issues. The participants also summarized tax practice operations in 2008, provided an assessment of current state of the practice concerned and made a forecast for 2009. Rather vivid was the discussion of legal management issue, in particular, enhancing tax practice of a law firm through restructuring unprofitable practices.

Vasil Kisil & Partners law firm was represented by senior associates Ivan Yurchenko and Andriy Stelmashchuk, recognized experts in tax law matters.

In particular, Ivan Yurchenko shared practical experience in respect of changes in the clients' priorities related to tax planning of M&A transactions which we have seen in 2009. In Mr. Yurchenko's opinion, currently clients are becoming more concerned about minimizing cash flows in closing deals, including through implementation of debt restructuring mechanisms. For avoidance of overcomplicated transactions companies need to thoroughly plan and estimate all potential tax and regulatory effects, including in other jurisdictions, and develop tailored approach to drafting documents for respective transactions. Company's extensive expertise in corporate and tax structuring of complex transactions is the guarantee of finding optimum solutions for the client's needs.

Commenting the question whether Vasil Kisil & Partners is going to establish Tax Litigation line within its Litigation practice, as many other legal firms now do, Andriy Stelmashchuk said that Litigation practice with Vasil Kisil & Partners is peer-recognized and one of the best in Ukraine. He mentioned that for a long period of time all the practice-concerned activities have included a great number of trials involving taxation issues. Besides, associates of VKP litigation practice are renowned specialists, particularly in terms of evaluating litigation opportunities of a taxpayer's eventual lawsuits with regulatory authorities, as well as determining risk mitigation means. Therefore, Tax Litigation line, Mr. Stelmashchuk said, has long ago come up as part of Vasil Kisil & Partners Litigation practice, and the engaged associates are now ready to face possible sharp increase in demand for Tax Litigation services.
