Vasil Kisil & Partners Represents Swedish Manufacturer in a Tax Dispute

10/10/2016

Vasil Kisil & Partners has successfully acted in a tax dispute for a Swedish investor, global leading manufacturer and supplier of highly-efficient metal-cutting tools.

As a result, the court ruled to set aside tax notice decisions that increased liabilities for corporate profit tax and value added tax due to the alleged sham nature of transactions related to the purchase of legal, personal recruitment, and transport management services.

Tetyana Berezhna, associate with the tax practice at Vasil Kisil & Partners, said, "The specifics of this dispute are that the tax authorities used the inspection report, which conclusions gave rise to the tax notice decisions in question, to challenge, just as it is a tradition, the true nature not only of the transportation services our client procured from its counterparties. This time they mistakenly held as sham transactions the legal services our firm previously rendered to this client relating to the other litigations. However, we successfully proved to the court that our opponent's conclusions in this tax dispute were unreasonable."

The project team also included Andriy Stelmashchuk, Managing Partner of Vasil Kisil & Partners, and associates Tetyana Berezhna and Maksym Maksymov.
