Vasil Kisil & Partners reviews the state of affairs in Ukraine for the prestigious Mergers & Acquisitions Review published by Law Business Research Ltd, London

30/10/2008

The second 2008 edition of The Mergers & Acquisitions Review published by Law Business Research Ltd, London, has “gone global” expanding its scope well beyond Europe. It is designed to help general counsel, government agencies and private practice lawyers understand the conditions that have been prevailing in global M&A markets in 2007-2008.

According to book’s editor Simon Robinson (Slaughter and May’s Partner) the last 18 months have been an unprecedented rollercoaster ride in the financial markets, witnessing record levels of M&A activity followed by an extremely sharp ‘credit crunch’ that hit the banks particularly hard.

For the second year in a row the chapter on Ukraine was contributed by Vasil Kisil & Partners’ Head of Corporate/M&A Practice, Denis Lysenko, Partner, and Anna Babych, Senior Associate. The authors state that in 2007 the Ukrainian M&A market set a new record for M&A deal value in the domestic market with aggregate deal value ~$14.5 billion, almost three times the figure of $4.8 billion for 2006.

Future developments and outlook section suggests that in 2008 most Ukrainian M&A deals will involve foreign investors, with an insignificant increase of domestic transactions in the total volume of deals. Other areas covered by the Ukraine chapter include legislative M&A framework, developments in corporate and takeover law and their impact, foreign involvement in M&A transactions, significant transactions, key developments and hot industries, financing of M&A, employment law, tax law, and competition law.
