Lawyers of Vasil Kisil & Partners successfully represented a Ukrainian company engaged in buying and selling real estate in a tax dispute concerning the rights of the company to the budgetary compensation of value added tax. District Administrative Court of Kyiv ruled that the company is entitled to a budgetary compensation of the value added tax exceeding UAH 12 million, which had been denied by the tax authorities.

According to project manager Andriy Stelmashchuk, ignorance of tax legislation by counterparties, even if this was the case may not result in deprivation of the right to VAT refund. The Company has fulfilled its obligations in good faith before the State budget.
