Construction of hotel-residential complex DIPLOMAT

Acting as a sole legal counsel to the municipal entity in construction of hotel-residential complex "DIPLOMAT" at 44-46 Gogolivska St. in Kyiv. The project assumed attraction of a private developer to construction who undertook all construction and financing risks. For this, the private developer was entitled to receive the constructed premises in ownership, save for the hotel "Diplomat", which was to be transferred to the GDIP. We advised the client on attraction of investor to residential part of the project, drafting and negotiating the investment agreements, establishing the mechanism of the customer's rights assignment and guarantees for receipt of the hotel by the client. Conducting negotiations, drafting all necessary agreements and other documentation on establishment of construction financing fund (CFF), elaboration of trilateral cooperation structure between the asset manager, the customer and the investor as a developer.
